In Fancher v. Fagella<\/em> (2007), a case involving neighboring townhomes in Fairfax County, the Supreme Court of Virginia adopted what’s known as the Hawaii rule. Under that approach, trees aren’t nuisances simply because they cast shade, drop leaves or fruit, or have branches or roots that cross the property line. An encroaching tree can become a nuisance, though, when it causes actual harm or poses an imminent danger of actual harm to the neighboring property.
